Abu Dhabi or Dubai: what's different when you buy off-plan?

By Tyler Newman, Host of The Off Plan ShowLast updated

The biggest day-one difference is the registration fee: 2% of the price in Abu Dhabi, registered with the Abu Dhabi Real Estate Centre (ADREC), against 4% in Dubai, registered with the Dubai Land Department (DLD). On a AED 7.4M villa at Y Views at BAYN that is AED 148,000, where the same price in Dubai would carry AED 296,000.

The other differences are where a foreigner can own (Abu Dhabi limits freehold for non-GCC buyers to investment zones), how the Golden Visa treats off-plan homes, and how each emirate's escrow and registration rules work. The Golden Visa threshold itself is AED 2M in both.

How much more is the registration fee in Dubai?

Twice as much as a share of the price. The DLD's initial-sale service lists 2% of the sale value for the seller and 2% for the purchaser, plus AED 10 knowledge and AED 10 innovation fees. Every Dubai project page on our site tells buyers to add the full 4% to the price.

In Abu Dhabi, ADREC's DARI platform lists 2% of the sale price for an off-plan ownership unit (1% for Musataha), plus an AED 400 electronic admin fee before VAT. ORA's fact sheet says Y Views at BAYN buyers pay the 2% on signing the SPA, and Aldar offered Yas Riva Reserve launch buyers a waiver of the 2%.

The table puts the fee in AED on six launches we cover. The Dubai figures are the 4% our project pages tell buyers to budget for; the Abu Dhabi figures are the standard 2%, before any developer waiver.

Who regulates an off-plan sale in each emirate?

In Dubai, the Dubai Land Department registers the sale and RERA, its regulatory arm, oversees developers and escrow accounts. The developer registers your Sale and Purchase Agreement (SPA) in the DLD's provisional register within 90 days of signing, and you receive a provisional registration e-certificate, the document buyers call the Oqood.

In Abu Dhabi, the Abu Dhabi Real Estate Centre (ADREC), set up under Executive Council Resolution No. 223 of 2023, regulates the sector, and sales are registered through its DARI platform. The developer starts the registration on DARI, the authority approves it, the party responsible pays the fee, and a sale certificate is issued that both buyer and seller can download. A late penalty of AED 10,000 applies if the developer doesn't register within 21 days of the contract date.

Abu Dhabi's Law No. 3 of 2015 also sets up an Initial Real Estate Register for off-plan units, which works much like Dubai's provisional register.

Where can foreigners buy freehold in Abu Dhabi?

Only in designated investment zones, if you are not a UAE or GCC national. The UAE government portal says an April 2019 amendment to Abu Dhabi's property law lets non-citizens own property inside investment zones. It names Yas Island, Saadiyat, Al Reem, Al Maryah, Al Raha Beach, Seih Al Sdeirah, Al Reef and Masdar City. The portal says there are nine zones but lists these eight.

Yas Riva Reserve is on Yas Island and Talay is on Saadiyat Island, so both are inside zones the portal names. Y Views at BAYN is in Ghantoot, which isn't on that list. Brokers describe BAYN as freehold for all nationalities, but we haven't found an official zone list that includes Ghantoot, so confirm the title type in your SPA before you book.

Dubai works differently: foreigners can buy outright, with no time limit, anywhere in the freehold areas set by Dubai's Regulation No. 3 of 2006.

Is the Golden Visa threshold the same in both emirates?

Yes, AED 2M, but the off-plan rules read differently. The federal ICP guide offers a 10-year residency for owning UAE property worth at least AED 2M, or for buying one or more off-plan units worth at least AED 2M from an approved local real estate company.

The DLD's investor Golden Visa service asks for property bought for AED 2M or more, fully owned by the applicant, allows a mortgaged home with a bank no-objection letter, requires you to be in the UAE when applying, and lists total fees of AED 9,884.75.

Abu Dhabi's ADDED page is stricter on off-plan: it asks for evidence that at least AED 2M has already been paid to the developer. On Yas Riva Reserve's AED 7.9M schedule, that is reached with the November 2028 instalment, when 30% (AED 2.37M) is paid. At Talay, AED 2.025M is paid by the September 2027 instalment on the schedule shown on our page. Rules change, so confirm with ICP or ADDED before you rely on a visa.

Can you get a mortgage on an off-plan home?

Some banks now lend before handover, but on a bank-by-bank basis. ADCB's off-plan mortgage, launched in April 2026, offers pre-approval for financing of up to 50% of the property value on off-plan homes from leading UAE developers, moving to final approval once 50% of the price has been paid or at handover.

At BAYN, our Y Views page notes that ADCB offers off-plan finance to eligible buyers once 50% has been paid. On the 60/40 plan, 20% is paid by the SPA and the next 40% during construction, so you reach the 50% mark partway through the construction instalments, whose dates ORA hasn't published. On Aldar's 50/50 plans, you reach it only at handover.

Abu Dhabi's Law No. 3 of 2015 also allows a buyer to mortgage the right to an off-plan unit registered in the Initial Register. We couldn't confirm a single emirate-wide "50% paid" rule on an official government page, so treat 50% as the bank's condition and check it with your lender.

How do the payment plans compare on real launches?

Aldar's two Abu Dhabi launches hold half the price back to handover: Talay and Yas Riva Reserve are both 50/50 with 5% on booking, and ORA's Y Views at BAYN is 60/40 with 10% on reservation and 10% on the SPA.

In Dubai, Emaar's Valia is 80/20 with 10% on booking, and Nakheel's Bay Estate is 60/40 with 20% on booking. Emaar hasn't published a payment plan for any cluster at The Valley on its website; its Q4 2026 agent notice says only that the standard payment plan applies, so ask for the plan on the exact unit.

Low deposits are not the same as low total cost. On Talay you still pay 50% of AED 13.5M, AED 6.75M, on handover, so plan how you will fund it before you sign.

How is your money protected in each emirate?

Both emirates require off-plan payments to go into a project escrow account. In Dubai, Law No. 8 of 2007 applies to every developer selling off-plan. The DLD says buyers' payments are deposited in the project's escrow account and paid out only to the contractors, consultants and marketing of that project. If a project is cancelled, the DLD's liquidation department asks the developer to return buyers' money within 60 days, and 5% is held in escrow for a year after completion as a defects guarantee.

In Abu Dhabi, Law No. 3 of 2015 requires a project escrow account whose funds may only be used to build and complete the project, with withdrawals controlled by ADREC.

Whichever emirate you buy in, check that the project is registered, pay only into the escrow account named in your SPA, and keep the registration certificate the developer obtains for you.

Quick answers

Is the registration fee really 2% in Abu Dhabi and 4% in Dubai?

Yes for off-plan sales. DARI lists 2% of the sale price plus an AED 400 admin fee before VAT. The DLD lists 2% seller and 2% buyer, and Dubai developers on our site ask buyers to add the full 4%.

Can a foreigner buy at Yas Riva Reserve or Talay?

Yas Island and Saadiyat Island are both named as Abu Dhabi investment zones on the UAE government portal, where non-citizens can own property.

Is BAYN in Dubai or Abu Dhabi?

Abu Dhabi. It is in Ghantoot, just past the Dubai border, so sales are registered with ADREC at 2%.

Does an off-plan home qualify for the Golden Visa?

The federal ICP guide accepts off-plan units worth at least AED 2M from an approved company. Abu Dhabi's ADDED page asks for proof that at least AED 2M has been paid to the developer. Confirm the current rule before you apply.

Who registers the sale, me or the developer?

The developer, in both emirates: within 90 days of the SPA in Dubai and within 21 days of the contract in Abu Dhabi.
